Terms of Service

You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to use our website or to engage our Services. If you are acting on behalf of an entity, you confirm that you are authorised to bind that entity to these Terms.

The website contains general information about our Services, illustrative before-and-after photographs, blog content, indicative timelines and educational guidance. None of this content constitutes a binding quote, engineering opinion, warranty, structural assessment or fitness-for-purpose statement. All pricing, feasibility and methodology are finalised only after a physical site inspection by our engineering team and the issuance of a written estimate.

• Submitting a form, calling, WhatsApping or otherwise contacting us creates no contractual obligation on either party.
• A binding engagement is formed only when the Customer accepts a written estimate / quotation issued by us and pays the agreed advance, after which a project-specific work order or contract will govern the engagement together with these Terms.
• Estimates are valid for 30 days unless otherwise stated and may be revised based on findings during site preparation, soil testing or structural inspection.

The Customer agrees, before and during the Services, to:

• Hold lawful ownership or written authorisation to alter the structure being lifted, shifted, realigned or restructured.
• Obtain (with our reasonable assistance) any municipal permissions, panchayat / society NOCs, electricity / water authority approvals or other regulatory clearances required for the project.
• Disclose all known structural defects, prior repairs, soil conditions, encroachments, drainage, underground utilities, gas / sewer lines and adjacent-property concerns prior to the start of work.
• Vacate the premises and remove personal belongings, valuables, electronics and fragile items before lifting or shifting work begins.
• Ensure safe vehicular and equipment access to the site.
• Settle invoices in accordance with the agreed payment milestones.

• All prices are quoted in Indian Rupees (INR / ₹) unless otherwise stated and are exclusive of GST and other applicable taxes, which the Customer shall bear at the prevailing rate.
• Standard payment milestones are: advance on order confirmation, progress payments at agreed structural milestones, and balance on completion. The exact schedule is set out in the project work order.
• Invoices are payable within 7 days of issue. Overdue amounts may attract interest at 1.5% per month, compounded monthly, to the extent permitted by law.
• We accept payments by bank transfer (NEFT / RTGS / IMPS), UPI and account-payee cheque. Cash payments above the limits prescribed under the Income Tax Act, 1961 are not accepted.

Estimated project timelines are indicative and depend on weather, site conditions, soil, structural surprises encountered during work, third-party utilities, customer cooperation and force-majeure events. We will make commercially reasonable efforts to meet the agreed schedule but do not guarantee a specific completion date unless expressly stated in writing.

Building lifting, shifting and structural realignment are inherently sensitive engineering operations. Despite our 25+ years of experience, ISO-certified processes and rigorous safety protocols, no contractor can entirely eliminate the risk of cosmetic cracks, settlement, plaster damage, tile dislodgement, glass breakage or minor finish damage during such work. We will:

• Conduct a structural assessment before commencing work.
• Use industry-appropriate jacks, beams, cribbing and engineered methodology.
• Repair cosmetic damage caused by us as part of the agreed scope, where applicable.

The Customer acknowledges these inherent risks and authorises us to proceed once the estimate and methodology are accepted.

Subject to the project-specific work order, we provide a structural workmanship guarantee on lifted / shifted / realigned structures for the period stated in the work order (commonly up to 40 years for structural settlement caused by our workmanship). This guarantee:

• Covers structural settlement directly attributable to the lifting / shifting / realignment work performed by us.
• Does not cover damage caused by earthquakes, floods, war, acts of God, subsequent renovation by third parties, structural overloading, illegal additions, soil liquefaction, neighbouring construction or wear and tear.
• Is non-transferable unless explicitly written into the work order.
• Requires the Customer to give us reasonable opportunity to inspect and remediate before any third-party intervention.

All content on the website — including text, photographs, before/after imagery, graphics, logos, the Maa Bhagwati & Balaji name, and methodologies — is the property of Maa Bhagwati & Balaji Building Lifting or its licensors and is protected by Indian and international copyright, trademark and unfair-competition laws. You may view and share links to our pages for personal, non-commercial use; you may not copy, modify, republish or use our content for commercial purposes without our prior written consent.

You agree not to:

• Use the website for any unlawful purpose or in violation of these Terms.
• Submit false, misleading or impersonating contact information.
• Send spam, automated submissions or content that is harmful, offensive, defamatory, or infringes any third-party right.
• Attempt to probe, scan, reverse-engineer or compromise the security of the website or its underlying infrastructure.
• Scrape or systematically download content using bots, crawlers or similar tools without our written consent.

We may suspend, throttle or permanently block access for any user who violates this section.

The website may link to third-party platforms (WhatsApp, Meta, Google Maps, YouTube, etc.) for your convenience. We are not responsible for the content, policies or practices of those platforms. Your use of them is governed by their own terms.

The website and any informational content are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy or uninterrupted availability. Reliance on website content alone, without an on-site engineering assessment, is at your sole risk.

To the maximum extent permitted by law, Maa Bhagwati & Balaji Building Lifting shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, business opportunity, goodwill or data, arising out of or in connection with the website or the Services. Our aggregate liability arising out of or relating to a project shall not exceed the total amount actually paid by the Customer to us under the relevant work order.

You agree to indemnify and hold harmless Maa Bhagwati & Balaji Building Lifting, its directors, employees and engineers from any claims, damages, costs and expenses (including reasonable legal fees) arising from (a) your breach of these Terms; (b) your breach of any law or third-party right; (c) inaccurate or incomplete information you provided about the property or its ownership; or (d) your misuse of the website.

Neither party will be liable for delays or failures caused by events beyond reasonable control, including earthquakes, floods, monsoons, fire, pandemic, riots, strikes, government action, regulatory shutdowns, supply-chain disruption or telecommunications failures.

We may terminate or suspend your access to the website at any time, without notice, for conduct that breaches these Terms. Sections that by their nature should survive termination (including IP, disclaimers, liability and governing law) will survive.

These Terms are governed by the laws of India. Subject to any mandatory consumer protection rights, any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts at our registered place of business.

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when they were last revised. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.
